Terms of Service
Effective October 28, 2026
Section 17 requires most disputes to be settled by individual binding arbitration and waives class actions. Please read it.
1. Who we are and what these terms cover
TeleFunnel Leads is a service of The Insurance Dudes ("we," "us," "our"), 5102 E Pima St, Tucson, AZ 85712. These Terms of Service ("Terms") govern your use of telefunnelleads.com and its subdomains (the "Site"), our waitlist, our client accounts, and the insurance leads we deliver (together, the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you use the Services for a company, you agree for that company and confirm you can bind it.
2. Business use only
The Services are for insurance businesses in the United States. You must be at least 18 and able to enter a binding contract. The Services are not offered to consumers shopping for insurance.
3. What we do, and what we are not
We buy insurance leads in real time from third-party lead providers and deliver them to the insurance agencies that buy from us ("Clients") at a flat price per lead, paid from a prepaid balance. We manage the buying on the Client's behalf.
We are not an insurance company, agency, or producer. We do not sell, quote, bind, or service insurance, and nothing on the Site is insurance, legal, tax, or financial advice. Calculators and models on the Site are planning tools built on the inputs you enter. They are estimates, not promises of any result.
4. Waitlist
If you join the waitlist, we will use the email address you give us to contact you about TeleFunnel Leads. A spot on the waitlist is not an offer or a commitment to provide the Services in your area.
5. Client accounts
- Client accounts are opened by agreement with us. You sign in with an account you control (for example, Google sign-in). Keep your sign-in secure and tell us at once if you think someone else has used it.
- You are responsible for everything done under your account and for the people you let use it.
- Information you give us about your agency, licenses, and billing must be accurate and kept up to date.
6. Price per lead, prepaid balance, and automatic refills
- Price. Your price per lead is set in your agreement with us and shown in your account. Each delivered lead is deducted from your prepaid balance at the price in effect when the funds used for it were added.
- Prepaid. Leads are delivered only against funds you have already paid. When your paid leads run out, delivery stops until you add funds.
- Automatic refill. If you turn on automatic refill, you authorize us to charge your saved payment method the refill amount you chose whenever your balance falls to $20.00 or less. We make at most one refill attempt per day. If a charge is declined, we will tell you and will not retry that day. You can turn automatic refill off at any time by telling us in writing; it stops before the next charge.
- Payment processing. Payments are processed by Stripe. Your card details are entered on Stripe's hosted pages and stored by Stripe. We never see or store your full card number.
- Price changes. We will tell you before we change your price per lead. A change applies to funds added after it takes effect. Funds already added are used at the price in effect when they were added.
- Taxes. Prices do not include taxes. You are responsible for any taxes that apply to your purchase, other than taxes on our income.
7. Returned leads and refunds
If a delivered lead is returned under a return reason accepted for your account, we credit its price back to your balance. Prepaid funds are not refundable as cash except as stated in your written agreement with us, as required by law, or as described in Section 16 when an account closes.
8. Delivery and results
We work to deliver the daily volume you ask for, but lead supply depends on consumer demand and on third-party providers. Daily targets are goals, not guarantees. We do not guarantee that any consumer will answer, buy, or qualify for insurance, or that you will reach any contact rate, close rate, or cost per sale. Lead information comes from consumers and third-party providers, and we do not guarantee that it is complete or accurate.
9. Your compliance duties
You decide whether, when, and how to contact each consumer. You are solely responsible for doing so lawfully. In particular you agree to:
- Hold every license required to offer insurance to the consumer in the consumer's state, and follow state insurance laws and your carriers' rules.
- Comply with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the National Do Not Call Registry, state do-not-call and telemarketing laws, calling-time limits, caller ID rules, call recording consent laws, and email and text messaging laws (including CAN-SPAM).
- Contact a consumer only within the scope of the consent the consumer gave, and honor every opt-out, do-not-call request, and revocation of consent promptly and across every channel you use.
- Use leads only to offer your own insurance products. You may not resell, share, rent, or transfer a lead or its data to anyone else.
- Protect lead data with reasonable security, use it only as these Terms allow, and delete it when a consumer asks or when the law requires.
- Tell us promptly about any consumer complaint, opt-out, legal demand, or regulatory inquiry involving a lead we delivered.
10. Consumer consent records
Our lead providers tell us that consumers asked to be contacted about insurance. Where a provider gives us a record of a consumer's consent, we will make it available to you on request. Your duties in Section 9 apply whether or not a consent record exists.
11. Confidential information
Our bidding methods, provider relationships, lead costs, and the contents of the staff and client applications are our confidential information. You may not share them or use them except to receive the Services.
12. Acceptable use of the Site
You may not: copy, scrape, or harvest the Site or its data; reverse engineer or probe its security; interfere with its operation; use bots or automated tools against it except search engine crawlers that follow our robots.txt; submit false information or another person's information without permission; or use the Services to break any law.
13. Ownership
The Site, the TeleFunnel Leads and The Insurance Dudes names and logos, and all software and content on the Site belong to us or our licensors. We give you a limited, revocable, non-transferable right to use the Site for its intended purpose. You keep ownership of the information you give us and let us use it to provide the Services.
14. Third-party services
The Services rely on third parties such as hosting, database, sign-in, payment, and lead platform providers. Their services are governed by their own terms, and we are not responsible for them. Links to other sites are for convenience only.
15. Disclaimers, limit of liability, and indemnity
Disclaimer. Except as expressly stated in these Terms, the Services are provided "as is" and "as available," without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Limit of liability. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business, even if told they were possible. Our total liability for all claims relating to the Services is limited to the amounts you paid us in the three months before the event giving rise to the claim. Some laws do not allow these limits, so they may not fully apply to you.
Indemnity. You will defend, indemnify, and hold harmless The Insurance Dudes and its owners, employees, and agents from any claim, fine, or cost (including reasonable attorneys' fees) arising from your contact with consumers, your use of leads, your breach of these Terms, or your violation of any law.
16. Suspension and closing an account
We may suspend or end the Services to you if you breach these Terms, if a regulator or provider requires it, or if we reasonably believe your use creates legal risk. You may close your account by telling us in writing. When an account closes, automatic refill stops, and any unused prepaid balance is handled under your written agreement with us or, if it says nothing, refunded to the original payment method. Sections 7, 9 through 11, 13, 15, 17, and 19 survive.
17. Disputes: arbitration and class action waiver
Talk first. Before filing any claim, the party with the claim will send the other a written description of it and the relief sought, and both will try in good faith to resolve it for 30 days.
Binding arbitration. Any dispute that is not resolved will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, in Pima County, Arizona, or by video if both agree. Judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small claims court, and either party may ask a court for an injunction to protect its intellectual property or confidential information.
No class actions. Claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not combine claims of different parties.
Governing law. These Terms are governed by the laws of the State of Arizona and the Federal Arbitration Act, without regard to conflict of law rules. For any matter not subject to arbitration, the state and federal courts in Pima County, Arizona have exclusive jurisdiction.
18. Electronic communications
You agree that we may send notices, receipts, and other communications to you electronically, and that electronic agreements and signatures have the same effect as signed paper ones. You agree that we may call or email you at the business contact details you give us about your account and the Services.
19. General
These Terms, together with any written agreement between you and us, are the entire agreement about the Services. If they conflict, the written agreement controls. If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms without our written consent. We may assign them with our business. Neither of us is liable for delays caused by events beyond reasonable control. Nothing in these Terms creates a partnership, joint venture, or agency relationship.
20. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date, and tell Clients about material changes before they take effect. Using the Services after a change takes effect means you accept it.
